OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees exposed to stuck-by falling loads hazards while operating a monorail crane, with an underhung trolley and hoist.  On or about January 14, 2026, the employer did not ensure employees were protected from struck-by falling load hazards while operating the Hoosier 5-Ton Crane, known to the employer as the "south crane", without a safety latch, exposing employees to struck-by hazards from an accidental load disengagement.   According to ASME B30.17-2020; Cranes and Monorails (With Underhung Trolley or Bridge); Section 17-3.3.4 Responsibilities of Operators, (16) use a hook latch when provided.  (17) Verify that the hook latch (when provided) is closed and not supporting any part of the load.

On or about January 14, 2026, the employer did not ensure the carabiner of a personal fall arrest lanyard used to anchor a personal fall protection system near the "burner pit" was connected to a suitable anchor point that was compatibly shaped to prevent the carabiner gate from being depressed in such a manner as to allow unintentional disengagement of the lanyard from the anchorage point.  The lanyard carabiner was directly attached (anchored) to the flange or lip of a steel wall girt, that did not permit the carabiner to fully close and lock on the anchorage point.
