29 CFR  1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):   a) 132 & 134 Harbour Drive, Lakewood NJ: The employer did not ensure that each worker who utilized a JLG 6042 All-Terrain lift at the worksite had received training which included formal instruction, hands on and an evaluation with a written certification of completion, on or about 01/22/26. On or about 01/22/26 the company worksite Foreman was operating a JLG 6042 All-Terrain lift to deliver and support a dog house dormer's pitched roof trusses to the company worksite Foreman and a company worker and performing other similar activities with this equipment.     NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- 132 & 134 Harbour Drive, Lakewood NJ: A worker and the company worksite Foreman were exposed to fall hazards, in excess of 24 feet 3 inches, when installing pitched roof trusses onto a framed dog house dormer and performing other related activities while walking and working from a residential structure's pitched roof trusses and exterior wall top plates without fall protection. Condition observed on or about 01/22/26.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM.  FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR  1926.503(a)(2): The employer did not assure that each employee exposed to fall hazards was trained by a competent person qualified in the areas specified in 29 CFR 1926.503 (a)(2)(i) through (viii)   a- 132 & 134 Harbour Drive, Lakewood NJ:   A worker and the company worksite Foreman were exposed to fall hazards, in excess of 24 feet 3 inches, when installing pitched roof trusses onto a framed dog house dormer and performing other related activities while walking and working from a residential structure's pitched roof trusses and exterior wall top plates without fall protection.  The company workers and the company worksite Foreman had not received fall protection training as specified in 29 CFR 1926.503 (a)(2)(i) through (viii).  Condition observed on or about 01/22/26.    NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR  1926.602(c)(1)(vi): Section 603(e) of American National Standard Institute, B56.1-1969 Safety Standards for Powered Industrial Trucks, as adopted by 29 CFR 1926.602(c)(1)(vi): When a truck was left unattended, load engaging means were not fully lowered, controls were not neutralized, power was not shut off, brakes were not set, and the key or connector plug was not removed:  a) 132 & 134 Harbour Drive, Lakewood NJ: On or about 01/22/26, a JLG 6042 All-Terrain lift, used to deliver and support a dog house dormer's pitched roof trusses to the company worksite Foreman and a company worker, who were working from pitched roof trusses and exterior wall top plates, was left unattended with the load engaging means raised and extended, the key left in the ignition, and the brake not set thereby exposing workers and the company worksite Foreman to the hazard of being struck by the vehicle or its elevated, unsupported load.
