29 CFR  1910.303(b)(7)(i):Unused openings in boxes, raceways, auxiliary gutters, cabinets, equipment cases, or housings were not effectively closed to afford protection substantially equivalent to the wall of the equipment:  (a)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that electrical equipment was effectively closed in that one electrical light switch box located adjacent to the Wash Bay door on the west wall in the Maintenance Bay was missing a knockout.  This condition exposed employees to electrical and fire hazards.  (b)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that electrical equipment was effectively closed in that an electrical pressure washer throw switch box located adjacent to the Wash Bay door on the west wall in the Maintenance Bay was missing a knockout.  This condition exposed employees to electrical and fire hazards.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure a written hazard communication program was developed, implemented, and maintained at the workplace prior to employee exposure to the following chemicals:  Engine Degreaser Hydraulic Fluid DefendAL Heavy Duty Antifreeze, Batch Number - BO-52163, Part Number 11491 Zerex Valvoline Global Operations, Part Number 895624 Argon/CO2, Oxygen, Acetylene Gas Cylinders Great Dane Genuine Parts - Trailer and Truck Lube, 11 oz Aerosol GD 56650  Peak Blue Diesel Exhaust Fluid, DEF ISO 2224 Used Motor Oil Performance Plus - Full Synthetic Heavy Duty ATF  PB Penetrating Catalyst  Abatement Note:  The written hazard communication program will also include:   (1) A list of the hazardous chemicals known to be present using an identity that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas); and,  (2) The methods the employer will use to inform employees of the hazards of non-routine tasks.  (3) The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section.

29 CFR 1910.1200(f)(6): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the information specified under paragraphs (f)(6)(i) through (ii) of this section:   (a)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that hazardous chemicals in the workplace were properly labeled, in that a 32 oz bottle containing engine degreaser, located on the north wall of the Maintenance Bay was not labeled. This condition exposed employees to chemical hazards.  (b)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that hazardous chemicals in the workplace were properly labeled, in that a clear 1 gallon bottle containing hydraulic fluid, located on the east wall of the Wash Bay was not labeled. This condition exposed employees to chemical hazards.  (c)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that hazardous chemicals in the workplace were properly labeled, in that two clear 150 gallon containers and one clear 250 gallon container containing used engine oil was located on the north wall area of the Maintenance Bay and were not labeled. This condition exposed employees to chemical hazards.  (d)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that hazardous chemicals in the workplace were properly labeled, in that one clear 32 oz bottle and one clear 2 gallon container containing window washing fluid, located on the south wall of the Maintenance Bay was not labeled. This condition exposed employees to chemical hazards.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  (a)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that employees were provided with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard is introduced into the work area for hazardous chemicals and substances that include, but are not limited to:   Engine Degreaser Hydraulic Fluid DefendAL Heavy Duty Antifreeze, Batch Number - BO-52163, Part Number 11491 Zerex Valvoline Global Operations, Part Number 895624 Argon/CO2, Oxygen, Acetylene Gas Cylinders Great Dane Genuine Parts - Trailer and Truck Lube, 11 oz Aerosol GD 56650  Peak Blue Diesel Exhaust Fluid, DEF ISO 2224 Used Motor Oil Performance Plus - Full Synthetic Heavy Duty ATF  PB Penetrating Catalyst  Abatement Note:  (a)	Employees shall be informed of:  (1)	Any operation in their work area where hazardous chemicals are present; and, (2)	The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section.  (b)	Employee training shall include at least:  (1)	Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (2)	The physical and health hazards of the chemicals in the work area; (3)	The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; (4)	The details of the hazardous communication program developed by the employer, including an explanation of the labeling system and the safety data sheet, and how employees can obtain and use the appropriate hazard information.

29 CFR  1910.37(b)(1):The exit route was not adequately lit:  (a)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that emergency lighting over the northwest emergency exit in the Maintenance Bay was functional in the event of a power outage or subsequent emergency in that lighting did not function on battery power.  This condition exposed employees to injuries associated with trips and falls while attempting emergency egress through the industrial shop area.  (b)Lakes Logistics, Inc. at 1809 North Louise Drive, Sioux Falls, SD 57107:  On or about and at times prior to February 10, 2026, the employer did not ensure that emergency lighting over the southwest emergency exit in the Maintenance Bay was functional in the event of a power outage or subsequent emergency in that lighting did not function on battery power.  This condition exposed employees to injuries associated with trips and falls while attempting emergency egress through the industrial shop area.
