29 CFR  1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On and before February 23, 2026, the employer had not ensured that each employee performing servicing and maintenance activities on the Rail Feeder Conveyor was trained at the level of an authorized employee in the recognition of, the type and magnitude of, and the methods and means necessary to control the hazardous energy posed by the equipment.

29 CFR  1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence:  a. On or about February 12, 2026, the employer did not ensure that an employee who was clearing material from the Sumitomo Rail Feeder Conveyor (Serial # VA0357703) while training the belt applied energy control procedures to control the hazardous electrical energy powering the belt. The employer failed to ensure that the energy control application steps were implemented as an energy isolation device was not utilized to isolate the conveyor from the electrical energy source [per the 1910.147(d)(3) requirements]. As a result, the remaining energy control elements, involving lockout device application [(d)(4)], dissipation of stored or residual energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to protect the employee from this machine hazard, thereby exposing the employee to caught-in and struck-by hazards.  b. On and before  February 23, 2026, the employer did not ensure that employees who change the wiper on the Sumitomo Rail Feeder Conveyor (Serial # VA0357703) applied energy control procedures to control the hazardous electrical energy powering the belt. The employer failed to ensure that the energy control application steps were implemented as an energy isolation device was not utilized to isolate the conveyor from the electrical energy source [per the 1910.147(d)(3) requirements]. As a result, the remaining energy control elements, involving lockout device application [(d)(4)], dissipation of stored or residual energy [(d)(5)], and verification of isolation [(d)(6)], were not implemented to protect the employee from this machine hazard, thereby exposing the employee to caught-in and struck-by hazards.

29 CFR  1910.147(f)(3)(ii)(D): Each authorized employee shall affix a personal lockout or tagout device to the group lockout device, group lockbox, or comparable mechanism when he or she begins work, and shall remove those devices when he or she stops working on the machine or equipment being serviced or maintained.  a. On and before February 23, 2026, the employer did not require each authorized employee who was performing servicing and maintenance on the rail feeder conveyor to apply a personal lockout device when performing maintenance on the equipment in a group with other employees.
