OLD BELLA VISTA PROPERTY OWNERS ASSOCIATION, INC.

An employee was attempting to cut a rooted tree in half. The tree was lodged into the railing of a bridge. The employee cut through half of the tree and then kicked the tree with his right foot to dislodge it from the railing of the bridge. The root part of the tree fell into the water, causing the top portion of the tree to plunge up and then back down, landing on the employee's left foot and pinning it between the bridge. The employee suffered a foot amputation.
