An employee was chipping a concrete wall to replace a railing on a roadway. He went to get into a better position by climbing into the bucket of a mini excavator. The thumb of the excavator closed on the employee, resulting in a fracture from his forehead to the top of his nose, a fractured right wrist and ankle, and a dislocated left ankle.
