Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recongnized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The employer did not furnish employment and a place of employment
which were free from recognized hazards that were causing or likely
to cause death of serious physical harm to employees in that
employees were exposed to the hazards created by direct inhalation
of solvent mists and vapors during application of solvent based
leather dyes using an oral atomizer, brushes and squeeze bottles.
Solvent Hazards present include, but are not limited to the
following:
acetone: central nervous system depressant, skin and eye irritant
benzaldelyde; central nervous stystem depressant, mutagen, allergen
methyl ethyl ketone: central and peripheral nervous system toxin
e-teratogen, eye irritant, skin irritant
ethyl benzene; skin and eye irritant, dizziness and tight chest,
teratogen
heptane; central nervous system depressant, highly toxic through
inhalation
formaldehyde; severe skin and eye irritant, mutagen, suspect carcinogen,
experimental tumorgenic agent, sensitizer
morpholine; skin and eye irritant, neopolastic agent, kidney toxic,
hepatotoxin, pulmonary toxin
methyl isobutyl Ketone; skin and eye irritant, CNS depressant.
nonanes; central nervous system depressant, respiratory irritant
toluene; psychotropic effects, central nervous system toxin, mutagen,
hepatotoxic, nephrotoxic
xylene; central nervous system depressant, eye irritant, hepatotoxic,
nephrotoxic
methanol; eye toxin, systemic toxin, psychometric
Among other methods, one feasible and acceptable abatement method to
correct this hazard is the implementation of an air pressure source
other than the operator's respiratory system. Such a source may include
the following:
1) Use of an air compressor to provide pressure for atomization of
solvent/dyes
2) Use of a compressed gas system employing cylinders or cartridges to
provide pressure for atomization of solvent/dyes.
3) Evaluation of and substitution with dye systems which do not use
solvent based dyes.
4) Implementation of a system which utilizes compressed air and spray
guns (such as air brushes) to apply dyes.
