Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) The hazard of being struck or crushed by a suddenly descending lift
while working under vehicles in that:
1) Lift #1 at the South side of the Service and Repair Area and the
truck lift on the West side did not have automatic safety devices
provided in accordance with Sections 3.1.10 and 3.2.1 of the
American National Standards Institute (ANSI) B153.1-1981, Safety
Requirements for the Construction, Care and Use of Automotive
Lifts.
2) The majority of the lifts (24 of 27) within the shop area were not
marked with the rated load capacity nor were the operating
instructions conspicuously posted in the lift areas (26 of 27
lifts) in accordance with Section 5.2 and 6.2.1 of American
National Standards Institute (ANSI) B153.1-1981, Safety
Requirements for the Construction, Care and Use of Automotive
Lifts.
Among other methods, one feasible and acceptable abatement method to
correct the hazard is:
To assure automatic mechanical safety devices, capacities and
lift operating instructions are provided on all vehicular lifts
in accordance with ANSI B153.1-1981.
