Section 5(a)(1) of the Occupational Safty and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazards of confined space:
On or about 3/14/86, the employer allowed and employee to enter the East
Cupola (a confined space) for the purpose of putting in a sand bottom
without having an established confined space entry procedure requiring
the implementation of a written permit system, employee training in
confined space entry procedures, testing and monitoring of the
atmosphere for the presence of sufficient oxygen and the absence of
hazardous levels of toxic or combustible gases or vapors, labeling and
posting of the area as a confined space and establishing a rescue
procedure.
Among other methods, one feasible and acceptable method to correct this
hazard is to establish and maintain a Confined Space Entry Program.
Such a program shall include, as a minimum, the following elements:
1) Written procedures which specify the permit system, ventilation
requirements, atmospheric tests, rescue procedure, and employee
training.
2) Warning sign and entry permit which document entry authorization,
location, type of work, pre-entry tests or air monitoring,
communications system, and personal protective equipment. The
employer shall be responsible for issuing the permit and shall sign
off before the work is started and after the work is completed.
Permits shall be issued daily and updated for each shift.
3) Mechanical Ventilation prior to entry and continuously as determined
by tests.
4) Atmospheric tests prior to each entry for the presence of sufficient
oxygen (19.5% to 25%) and the absence of toxic or flammable
substances. Monitoring shall be continuous when the work process or
other conditions could introduce a hazardous atmosphere.
5) Rescue procedures and equipment for rescue and communication,
including safety harnesses, lifelines, hoist, and positive pressure
self-contained breathing apparatus as appropriate.
6) Training of personnel who work in confined spaces; of standby
personnel who monitor and communicate with the workers; and of rescue
personnel. Training shall include review of hazards, rescue
procedures, and use of test and protective equipment.
