Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Employees were exposed to the hazards of falls from an elevated work
platform (cage) because employee(s) were being transported between
work locations with the work platform (cage) in an elevated position
and because the work platform (cage) was not secured (fastened) to
the lifting carriage and/or forks of the "Baker Motor True"
industrial fork lift.
One feasible and acceptable abatement method, among others, to correct
this hazard is to:
1) Secure the work platform (cage) to the lifting carriage and/or forks
lift before it is elevated.
2) Prohibit the movement of fork lift trucks while employee(s) are
elevated on the work platform (cage).
3) Instruct and train all fork lift operators to observe the safety
rules.
