Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 4/6/87, employees were exposed to the hazards of being struck or crushed by a dislodged and swinging dumpsters during the process of emptying its contents into the rear hopper of a refuse collector, because the container locks (Trunion Locking Devices) were removed from the refuse truck, allowing the dumpster to become dislodged during operation. One feasible and acceptable abatement method, among others, to correct this hazard is to reinstall, use and maintain the container locking devices on the rear of refuse truck operation.
