Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) The employer did not protect his employees from the recognized hazard of being struck by the Break Out Tong Assembly. A method of protection for employees would be the use of wire rope cable on the Break Out Tong Assembly (snub line) that is in good condition, not damaged or defective due to breakage, deterioration or wear. Employees were exposed to the hazard of being struck by the Break Out Tong Assembly in areas such as: Clubb #1, Rig #1, Daisetta, Texas.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) The employer did not protect his employees from the recognized hazard of being trapped on the Derrick Racking Board Platform of an oil rig in the event of a fire, smoke or other emergencies. A method of protection for employees would be to provide a specially rigged and securely anchored escape line attached to the derrick or mast so as to provide a ready and convenient means of escape from the Derrickman's Working Platform in areas such as: Clubb #1, Rig #1, Daisetta, Texas, no geronimo or safety line mounted at the pipe racking board.
