Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees in the Service
Department were exposed to serious injury that could result from being
struck by unexpected movement of automotive lifts and/or lifting devices
due to the following unsafe conditions or practices:
a) Many lifts had missing metal keeper straps on all pads supporting
sleeves.
b) Spring return on lift control mechanism(s) did not return to neutral
or off position when released.
c) Safety locking devices on some lifts were missing or did not
function.
d) Fluid leaks.
e) The employer did not maintain and care for lifts to ensure continued
safe operation.
f) The employer did not ensure that operators of automotive lifts were
instructed in the safe use and operation of the lifts.
g) The employer did not establish a periodic inspection procedure as
recommended by the manufacturer to ensure the safe operation of the
lift.
Among other methods, one useful and feasible method to correct these
hazards would be to establish and implement inspection, maintenance
and operator training programs in accordance with the lift
manufacturers instructions and/or automotive lift institute; American
National Standards Institute, ANSI B153.1-1981, entitled Safety
Requirements For The Construction, Care and Use of Automotive
Lifts may also serve as a useful guide in developing such programs.
