Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The recognized hazard of contracting blood borne diseases through possible direct contact with blood and body fluids, in that phlebotomists, centrifuge technicians, and receptionists at Acadians Plasma Center were not offered Hepatitis B vaccination at no cost, in amounts and at time prescribed by standard medical practice, nor were adequate instructions provided on utilization of protective measures to prevent and avoid unneccesary exposures.
