Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
being struck by falling cargo which could result in serious injuries or
death. On June 15, 1988, Pier 8A Vessel CANTUARIA Hold #3 while
unloading the ship, the employees were allowed to be under the load
being lifted by the ship's gear.
Among other methods, one feasible and acceptable abatement method is to
require the operator avoid carrying loads over people and to instruct
people to stay clear from load being lifted.
