SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO THE HAZARD OF FALLING OFF OF A MOVING VEHICLE WHILE TRAVELING IN TRAFFIC ON OR ABOUT 10/24/90. LOCATION 43RD STREET AT 8TH AVENUE EMPLOYEES WERE OBSERVED RIDING ALONGSIDE THE CAB OF A DYNAHOE 490 BACKHOE THAT WAS TRAVELING IN TRAFFIC. THE EMPLOYEES WERE RIDERS, OTHER THAN THE OPERATOR OF THE MACHINE, WHICH WAS A ONE PERSON MACHINE NOT EQUIPPED WITH SEATS AND SEAT BELTS FOR RIDERS. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO ALLOW ONLY THE OPERATOR TO RIDE ON THE UNIT, PROHIBITING ALL OTHER RIDERS.
