Section 5(a)(1) of the Occupational Safety and Healthact of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of a falling under-hung hoist or portions thereof, caused by
overloading the Maxwell & Moore Load Lifter Hoist #9278 located in front
and to the side of paint booth. This hazard recognized by ANSI B30.11-
1980, Section 11-3.2.1, and ANSI B-30.16-1981, Section 16-3.1.2
a) Among other methods of abatement is to ensure that the load limit of
the hoist is not exceeded when lifting motors and other equipment.
Other hoists were available in the immediate area and are of greater
lifting capacity.
