Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about March 29, 1990, and at times prior to, at the company facility of Stuelpnagels, Inc., located at 215 Mulberry Street, Yankton, South Dakota, employees were exposed to the hazard of a fall or being crushed by the moving freight elevator or other injuries because of the following conditions: 1) The freight elevator was not provided with a complete car enclosure, including the top. 2) The hoistway enclosure door on second floor and loading dock were not extended to a full six feet in height. 3) The hoistway enclosure doors on the first floor, second floor, and loading dock landings were not provided with combination hoistway door mechanical locks and electric contacts or interlocks. 4) The freight elevator car was not provided with a door with interlocks. 5) The freight elevator car was not provided with a capacity plate, data plate, and a sign indicating its use. Feasible and acceptable methods of correcting these hazards, among others, would be: 1) Provide a complete freight car enclosure to a full height of six feet including the top. 2) Extend the doors/gates on the second floor and loading dock to a full height of six feet. 3) Install combination hoistway door mechanical locks and electric contacts or interlocks on the hoistway enclosure doors on the first floor, second floor, and loading dock landings to prevent the doors from being opened when the car is not at one of the landings. 4) Install electrical contacts on the freight elevator car door/gate to prevent the freight elevator from moving when the door is not in the closed position. 5) Install a capacity plate, data plate, and a sign indicating its use such as "This Elevator Designed for Freight Loading".
