Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
fall hazards and falling material hazards due to inadequate design of
the passenger elevator:
a) On or about September 11, 1990, and at times prior to, the passenger
elevator did not have proper clearance between the passenger elevator
car and the upper floor landing, exposing employees to potential
injury caused by the car striking the hoistway landing sill.
One feasible method of abatement, among others, would be to provide
clearance between the car platform and the hoistway landing sill as
required in ANSI A17.1-1984, Rule 108.1d.
b) On or about September 11, 1990, and at time prior to, the passenger
elevator used by employees had the car top door missing exposing
employees to a potential injury from falling materials.
One feasible method of abatement, among others, would be to install
or replace the door as required by ANSI A17.1-1984, Rule 204.1e.
c) On or about September 11, 1990, and at times prior to, the passenger
elevator car door was not equipped with car door electric contacts
that would prevent the car from moving unless the car door is in
the closed position, exposing employees to potential fall hazards.
One feasible method of abatement, among others, would be to install
electric contacts on the passenger elevator car door as required by
ANSI A17.1-1984, Rule 111.2.
