Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Construction site: Employee was exposed to the hazard of working from a raised wooden platform which was not secured to the lifting carriage and/or forks of the Case 580 C forklift. One feasible and acceptable means of abatement, among others would be to secure the platform to the carriage of forks.
