Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards in that: a) On or about December 18, 1989 and at times prior thereto at Fruehauf Trailer operations, employees were exposed to the hazard of thelack of adequate rescue means during confined space entry while repairing and cleaning tank trailers. One feasible and acceptable abatement method, among others, to correct this hazard is to: Provide standby employees constantly available at the entry site who have suitable resue equipment immediately available for emergency use and who are in constant visual or voice contact with the employee(s) in the confined space.
