Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physcial harm to employees in that:
a) On or about 11-1-89 and at times prior thereto at L A Construction,
Inc. an employee was exposed to the hazard of being crushed by
equipment rollover while performing earth moving operationwith a
D-8 H Caterpillar Tractor serial No. 46A2286.
Two feasible and acceptable abatement methods, among others, to correct
this hazard are to install a Rollover Protective Structure (ROPS) on the
equipment or limit equipment operation to terrain wherea rollover
hazard does not exist.
