Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 1/17/90, and at times prior thereto, at Western Sugar, Billings, Montana, employees were exposed to the hazard of fire and explosion due to the presence of a gas fired boiler adjacentto the sugar warehouse. The boiler was not approved for Class II, Division II, hazardous locations. Feasible and acceptable abatement methods among others, to correct this hazard are to remove the boiler or make the doors leading into the sugar warehouse dust tight.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 01/11/90 and at times prior thereto, at Western Sugar, Billings, Montana employees were exposed to the hazard of being struck by falling concrete and bricks due to deterioration of the roof and walls in the Raymond Mill and Lime Kiln Buildings and the outside walls of the Gas Compressor Room. Feasible and acceptable abatement methods, among others, to correct this hazard are to secure the concrete and bricks to the roof and walls and permanently repair the buildings for general occupancy. Step 1: Immediate Step 1: Temporary repairs shall be accomplished to contain the concrete and bricks on the roof and walls for abatement of the immediate hazard to employees. Step 2: 30 Days Step 2: An in depth structural analysis shall be performed on the affected buildings. Step 3: 45 Days Step 3: A written plan shall be submitted to the Area Director for the reconstructive steps to be undertaken. Step 4: 90 Days Step 4: Necessary repairs, alterations, modifications or rebuilding of structures shall be performed as required to assure complete structural integrity of the affected buildings prior to general use. ABATEMENT NOTE: Step 1 was accomplished by temporarily bracing, securing and containing hazardous concrete and bricks on 1/3/90.
