Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to fractures and crushing injuries from inadvertently falling
or being thrown from the fender of the JCB Backhoe as it transported
two employees from under the bridge on Rt. 81 to the topside of the
bridge on Rt. 60, to the work area:
a.   Among other methods, one feasible and acceptable
abatement method to correct this hazard would be
to refuse to let employees, other than the operator,
ride on any part of the backhoe not furnished with
a seat and seatbelt, on or about July 21, 1992.
