Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to hazards from being struck by machinery:
a.   The following conditions contributed to the unsafe
condition:
1)  A Ben's Run Recycling employee and a contractor
employee were permitted entry into the back of an open
bed truck containing "salt cakes" in violation of
company verbal policy; 2)  The two employees were in

being inappropriatgely used to strike a salt cake in an
attempt to dislodge it, thus placing the employee's in the
bucket and/or salt cale;
3)  The backhoe was being inappropriately used in that it
was striking the salt cake with the side of the bucket
upon failure to nudge it.  The backhoe had insufficient
power to edge the cake with the side of the bucket;
4)  Procedure calls for m oving cakes with a Rams Harm
or using a crane to lift and move salt cakes and employees
were permitted to circumvent the procedures.
Among other methods, one feasible and useful method to correct this
hazardous condition is to keep employees out of the bed of open bedded
trucks containing salt cakes and to follow procedures to adjust salt
cakes in the back of the truck bed.

a.   The following conditions contributed to the unsafe
condition:
1)  A Ben's Run Recycling employee and a contractor employee
were permitted entry into the back of an open bed truck
containing "salt cakes" that could shift and fall on them in
violation of company verbal policy;
2)  The two employees were in the truck bed  while backhoe was
used to strike the salt cake in an attempt to dislodge it, thus
placing the employees in the path of the salt cake;
3)  The backhoe was being inappropriately used in that it was
striking the salt cake with the side of the bucket upon failure
to nudge it.  The backhoe had insufficient power to edge the
cake with the side of the bucket;
4)  Procedure calls for moving cakes with a Rams Horn or using
a crane to lift and move salt cakes and employees were permitted
to circumvent the procedures.
Among other methods one feasible and useful method to correct this
hazardous condition is to keep employees out of the bed of open bedded
trucks containing salt cakes and to follow procedures to adjust salt
cakes in the back of the truck bed.
