Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards in that the employer did not utilize the written confined space procedure to adequately protect employees entering confined spaces as far as conducting air testing prior to an employee entering the #3 Cyclone and the employer did not utilize the Written confined space procedure to adequately protect employees entering confined spaces as far as the confined space entry permit was not used: a. Among other methods, one feasible and acceptable abatement method would be to obtain air monitoring equipment and test the air content prior to entry, on or about December 20, 1991. b. Among other methods, one feasible and acceptable abatement method would be to obtain, complete and post the confined space entry permit, on or about December 20, 1991.
