Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of being struck or crushed by a descending vehicular lift in that Lift #2 on the south side of the shop did not have a functional safety device to prevent descent of lift while in use and/or while elevated. Among other methods, one feasible and acceptable abatement method to correct this hazard is: To assure a safety device to prevent descent is installed, maintained and inspected on all vehicular lifts in accordance with ANSI Standard B 153.1 - 1974 and the manufacturer's recommendations.
