Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were cusing or likely to cause death or serious physical harm to employees in that: a) H20 Construction and Maintenance, Lakewood, CO: Employees were exposed to potential oxygen deficient and/or hazardous flammable and toxic sewer gas atmospheres during confined spaces entry associated with sewer cleaning and maintenance, on or about November 4 in the vicinity of 38th and Wadsworth, Wheatridge, CO., without benefit of comprehensive confirmed space entry procedures in that: 1. A confined space entry permit system was not in place. 2. Atmospheric testing was not done prior to all confined space entries. 3. An adequate emergency recuse program was not in place. 4. The confined spaces were not ventilated prior to entry. 5. Employees had not been adequately trained. Among other methods, one feasible and acceptable abatement method to correct this hazard is the implementation of a confined space entry program.
