Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment that were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees, In that employees were exposed to
being struck by a Case Loader Backhoe, Model 5800, with 7' 6" x 12',
2700 lb, blasting mat attached to the load bucket's hook by a chain
sling elevated in the maximum position while operating and traveling
over sloped, displaced pavement.  Equipment used was not appropriate
for the task involved.

One feasible and acceptable method, among others, to correct this
hazard is:
1) Discontinue use of loader backhoe as a crane.
2) Prohibit traveling while load bucket is extended to maximum
elevation.
3) Train and provide operator with a copy of the operator's manual to
ensure adherence to manufacturer's instructions for machine
operation.
4) Use equipment properly rated for task to be performed.
