Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
(a)  Tower Road and 56th Street - Employees were exposed to the
hazard of being hoisted in the bucket of the Caterpillar over an
approximately 10 feet deep excavation while securing a communication
line to a PVC pipe.
Among other methods, one feasible and acceptable abatement method
to correct this hazrard is:  prohibit the lifting of any employee(s)
in or on he backhoe arm or bucket.  Preplanning of the job should
include providing support of the crossing lines prior to opening of
the excavation to a hazardous depth.
