Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the potential of overexposure to welding fumes and/or an oxygen deficient atmosphere while welding, grinding and/or solvent cleaning between the interior baffles of cryogenic cylinders under construction. The company's existing confined space entry program (Procedure MCP -004, 5/14/92) did not address employee entry between the baffles of these cylinders. (a) On 12/03/92, employees were observed working between these baffles without permitted entry. Entry between these baffles for the purpose of welding, grinding, and/or solvent cleaning is considered a permit-required confined space entry. ABATEMENT NOTE: A confined space entry program meeting the requirements of 29 CFR 1910.146 shall be developed and implemented for all permit and non-permit required confined space
