Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) The hazard of death or serious physical harm from worn equipment, in that on or about 7/30/92 an employee was working with B.J. Breakout tong #111995, on Rig #43 S.W. of N.E., Section 26, 6 North, 81 West, Routt County, Milnor, CO, which shattered and the latch jaw portion hit the employee on the back of the head causing death to the employee. Among other methods one feasible method of abatement would be to replace the breakout tons or repair the breakout tongs when measurements indicate that the tongs are out of tolerance.
