Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation from the hazard of oxygen deficiency and toxic during confined space entry: (a) On 3/19/93, two employees performed welding inside of pipes with diameters of 37 1/2" at rotator #7 and rotator #9. The employees were inside of the pipes for the majority of the nine hour shift. An exhaust ventilation system was being used at rotator #9 for the entire shift, and at rotator #7 for a portion of the shift. both employees exposures to welding fume were in excess of mg/m3, recognized by the employer as the exposure limit for welding fume as evidenced by the reports generated by CNA for Thompson Pipe and Steel Company. One employee was overexposed to iron oxide and total particulate. This process in performed on a daily basis, during each of three shifts. The employer had not developed or implemented a confined space entry program which included: 1. A confined space entry permit system; 2. Training methods to alert affected employees to the hazards associated with entering a confined space, and the methods that employees could use to minimize these hazards; 3. Procedures for atmospheric testing for oxygen deficiency, flammable gas, and toxic air contaminants prior to entering the confined space; 4. Use of mechanical ventilation to purge the confined space of dangerous atmospheric contaminants and to maintain a supply of fresh air; and 5. An emergency response rescue program. A feasible and acceptable method to abate these hazards is to develop and implement a confined space entry program consistent with 29 CFR
