Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) McStain Enterprises, Pine Creek Homes, 731 Ponderosa, Louisville: As the controlling employer, McStain Enterprises did not ensure that the subcontractors employees exposed to a fall hazard of 9 - 13 feet to the ground below while painting, were protected from falling by a safety belt and lanyard or other means of fall protection. One feasible method to correct this hazard is to use a safety belt and lanyrad while painting the exterior trim.
