Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of lacerations from falling panes of glass onto employees, due to overlaoding the A-frame carts: (a) Champagne Industry Inc., Glass Line area: Employees are subject to serious injury from lacerations received during the loading and unloading process from the Wooden A-Frame racks used to store the panes of glass. The racks are not rated for the load capacity, and employees have sustained serious lacerations. Among other methods, one feasible and acceptable abatement method to correct his hazard is to determine the load rating of each cart and post, the rating on each cart for the employees knowledge to prevent overloading in the future.
