Section 5 (a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that:
a) On or about 6/22/89, and at times prior thereto at Northwest Piping,
Inc., Pablo, Montana, an employee was exposed to the hazard of
being crushed by equipment rollover while performing earth moving
operations on a grade of approximately 25% with a 1960 D7 Caterpillar
tractor, Serial No. 17A15694.
Two feasible and acceptable abatement methods, among others, to correct
this hazard are to install a Rollover Protective Structure (ROPS) on the
equipment or limit equipment operation to terrian where a rollover
hazard does not exist.
