Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) Construction Area:  An employee was exposed to the hazard of having
no means of egress in an emergency situation while working on a
platform elevated by a Sellick industrial truck to a height of
approximately 14 feet.
Two feasible and acceptable abatement methods, among others, to correct
this hazard are to require an operator to remain at the controls of the
equipment or install elevatable controls in the work platform.
