Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) On or about September 20, 1989, at Shumaker Trucking and Excavating
Contractors, Inc., Malmstrom Air Force Base, Montana, an employee was
exposed to the hazard of being crushed by equipment rollover while
performing earth moving operations on a grade of approximately 45%
with a 1969 D6C Caterpillar Tractor, Serial Number 10K2317.
Two feasible and acceptable abatement methods, among othersto correct
this hazard are to install a Rollover Protective Structure(ROPS) on
the equipment, or limit equipment operation to terrain where a rollover
hazard does not exist.
