Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Health care workers, such as but not limited to, physician assistants, nurses, nurses aides, and housekeepers, working in the clinic, the after hours clinic, patient care areas or in other areas throughout the clinics and nursing home, were exposed to the hazard of being infected by Hepatitis B Virus (HBV) and/or Human Immunodefiency Virus (HIV) through possible direct contact with blood or other fluids. Feasible and useful abatement methods for reducing this hazard, among others, are: 1) Informing, obtaining consent and testing all sources patients for HIV and HBV infections following percutaneous (needlestick or cut), blood or body fluids or cutaneous exposure to blood when worker's skin is chapped, abraded, or otherwise non-intact. 2) Clinically and serologically evaluating health care workers for evidence of HIV infection as soon as possible following all exposures as listed above, in which seronegativity of the source patient has not been confirmed. HIV antibody testing shall be performed as soon as possible and HIV seronegative workers shall be retested at 6 weeks, 12 weeks and 6 months post-exposure. Workers shall be advised to report and seek medical evaluation of any acute febrile illness that occurs within 12 weeks after exposure. 3) Providing the Hepatitis B vaccination series free of charge to employees involved in direct patient care in the clinics and the nursing home. Follow up procedures shall be taken for health care workers exposed or potentially exposed to the Hepatitis B Virus. The follow up procedures depend on the immunization status of the worker (i.e., whether HBV vaccination has been received and antibody response is adequate) and the HBV serologic status of the source patient. 4) Training personnel not to recap needles and providing sharps disposal containers in the immediate area where needles and other sharp instruments are used.
