Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: A) The employees did not establish and utilize a confined space entry procedure that adequately protected employees entering confined space Boiler #1, 6th Floor, Cycline, refractory process. Boiler #1, 6th Floor, refractory process with high content of crystalline silica (quartz and/or cristobalite), on or about November 20, 1990. Among other methods, one feasible and acceptable abatement method to correct hazards is: 1) Posting of written confined space entry procedures adjacent to tanks, vessels, and other confined space area which may be entered. 2) Ventilation procedures to remove dust and silica and other residue from confined space. 3) Implementation of established lock out and isolation procedures, where applicable, and issuance of a proper entry permit prior to confined space entry. 4) Use of atmospheric testing procedures to determine the presence of hazardous air contaminants and potential oxygen deficiency prior to confined space entry. 5) Where it has been determined that the confined space contains a hazardous air contaminant level and/or oxygen deficiency, use of mechanically-induced ventilation in the confined space before entry and during occupancy and for use of respiratory protective equipment which provides adequate protection against the hazard encountered. 6) Use of appropriate protective clothing and equipment, including safety harnesses and safety lines.
