Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to incompatible chemical storage which could lead to fire, explosion or generation of toxic gas. In the Patina Room, chemical storage area, 3 bottles con- taining concentrated nitric acid, four 1-pound bottles containing liquid ferric nitrate, one 1-pound bottle con- taining liquid cupric nitrate liquid cupric nitrate, one 5 gallon drum of Incralac which contains toluene, xylene and methyl ethyl ketone were stored with in close proximity to each other. (a) Accidental mixture of nitric acid with toluene, xylene and methyl ethyl ketone can result in a violent reaction. Among other methods, one feasible and acceptable method to abate this hazard are to store these incompatible chemicals in separate physical locations or to store the highly reactive chemicals (nitric acid, ferric and cupric nitrate) each in separate approved chemical storage cabinets.
