Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The

employer did not furnish employment and a place of employment which
were free from recognized hazards in that:
a.  On or about 3/18/91, and 3/26/91, and at times prior thereto
at the Pierce Island Waste Water Treatment Facility, employees
were exposed to the hazard of fire/explosion and/or asphyxiation
as a result of entering a confined space while applying flammable
waterproofing product to the interior walls of an aeration tank
and checking the walls of the tank for future coats of product.
ABATEMENT NOTE:  One feasible and acceptable abatement method, among
others, to correct this hazard is to:
Develop and implement a confined space entry program which meets the
criteria outlined in NIOSH Publication 80-106 "Working in Confined
Spaces."
Implement a confined space entry program which includes as a minimum:
Purging and ventilation of all tanks inside of which flammable chemicals
/materials were used or applied prior to tank entry.  Atmospheric
testing for oxygen deficiencies, flammable/explosive vapors, and toxic
gases prior to and during employee entry into the confined space and
documentation of such testing.  Use of electrically-operated tools,
equipment and electrical circuits which are grounded and approved for
work in the particular atmosphere (approved for Class I location).
Disconnecting and/or blank flanging of all piping entering and leaving
the confined space.  Provision of standby employee(s) constantly
available at the entry site who have suitable rescue equipment
immediately available for emergency use and who are in constant visual
or voice contact with the employees in the confined space.  Provision
and use of appropriate respiratory protective equipment during confined
space entry.  Provision and use of appropriate personal protective
equipment for the head, eyes, and skin during confined space entry.
Employee training on safe confined space entry procedures.  Use of a
written permit system which provides for review and signature by
responsible management officials and which includes, as a minimum, the
above-listed safeguards.
