Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which
were free from recognized hazards that were causing or likely to cause
death or serious physical harm to employees in that employees were
exposed to:
Employees performing grain elevator operations while utilizing
passenger elevator, are exposed to fall hazards due to poor
maintenance and the absence of an inspection program. This is
evidenced by the accident which occurred on or about February
25, 1991. Two employees riding in the elevator were injured
because the elevator free-fell 90 feet to the ground below. The
elevator had not been inspected since it was installed 10 years
ago.
Feasable and useful abatement methods for elimination of the
hazard include, but are not limited to:
1.    Establish a maintenance program in accordance to ANSI
A17.1.1971 for elevator maintenance. The elements of the program
are:
a) Periodic maintenance inspections at intervals no longer
than 6 months.
b) The safety governor and oil buffer shall be inpsected
and tested for conformance with the requirements of rules
100.2 through 100.5 of ANSI Section A.17.1971. At intervals
of not more than twelve (12) months unless regular
maintenance and inspections indicate tests should be made
at shorter intervals.
