SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE

EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WERE
FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH
OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO:
A) EMPLOYEES WERE REQUIRED TO DRAIN OIL FROM ANHYDROUS AMMONIA
REFRIGERATION SEPARATORS AND WERE EXPOSED TO A CONCENTRATION
OF AMMONIA IMMEDIATELY DANGEROUS TO LIFE AND HEALTH DUE TO A
NON-INCIDENTAL RELEASE AS A RESULT OF A LACK OF AN ESTABLISHED
MECHANICAL MAINTENANCE PROGRAM. THE LACK OF AN ESTABLISHED
MECHANICALMAINTENANCE PROGRAM RESULTED IN THE FAILURE OF THE
EMPLOYER TO TRAIN EMPLOYEES TO DRAIN OIL FROM THE SEPARATOR USING
SAFE WORK PRACTICES AND A CONSEQUENT FAILURE BY EMPLOYEES TO
EXERCISE NECESSARY CAUTION DURING OIL DRAINING OPERATIONS.
FEASIBLE AND USEFUL METHODS FOR ELIMINATION OF THE HAZARD INCLUDE, BUT
ARE NOT NECESSARILY LIMITED TO:
1) THE ESTABLISHMENT OF A MECHANICAL MAINTENANCE PROGRAM IN ACCORDANCE
TO THE AMERICAN SOCIETY OF HEATING, REFRIGERATION AND AIR-
CONDITIONING ENGINEERS (ASHRAE) SYSTEMS HANDBOOK, 1980, CHAPTER #32.
ESSENTIAL ELEMENTS OF THE PROGRAM INCLUDE:
A) MANAGEMENT MAINTENANCE POLICY,
B) INVENTORIES AND RECORDS,
C) PROCEDURES AND SCHEDULES TO INCLUDE SERVICE AND REPAIRS,
D) ORGANIZATIONAL STRUCTURES,
E) STAFFING,
F) SYSTEM OF RECORDS, AND
G) OPERATING AND MAINTENANCE MANUALS.
2) THE PROVISION OF TRAINING TO EMPLOYEES REGARDING THE ELEMENTS OF
THE MECHANICAL MAINTENANCE PROGRAM.
