SECTION 5(A)(1) OF THE OCCUPATIONAL SAFETY AND HEALTH ACT OF 1970: THE EMPLOYER DID NOT FURNISH EMPLOYMENT AND A PLACE OF EMPLOYMENT WHICH WAS FREE FROM RECOGNIZED HAZARDS THAT WERE CAUSING OR LIKELY TO CAUSE DEATH OR SERIOUS PHYSICAL HARM TO EMPLOYEES IN THAT EMPLOYEES WERE EXPOSED TO FALL HAZARDS FROM CATENARY SCAFFOLDS: A) ON OR ABOUT 9/13/90 AT THE ROUTE 20 BRIDGE OVER ROUTE 219 - EMPLOYEES PAINTING BRIDGE GIRDERS FROM CATENARY SCAFFOLDS APPROXIMATELY 14'9" ABOVE THE GROUND WITHOUT ANY FALL PROTECTION BEING UTILIZED. AMONG OTHER METHODS, A FEASIBLE AND ACCEPTABLE METHOD OF ABATEMENT IS TO PROVIDE AND UTILIZE SAFETY BELTS, OR THE EQUIVALENT ATTACHED TO A LIFELINE AS STIPULATED BY SECTION 20.6 OF ANSI A 10.8-1988, SCAFFOLDING- SAFETY REQUIREMENTS.
