Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
of serious physical harm to employees who were entering or leaving the
building were subjcect to being struck by materials that could fall from
the building or from the overhead tower crane:
a) Ground Area of the Tower - overhead protection was not provided
for employees. Observed 8/28/89
Abatement Note: A feasible and useful means of abatement would be to
install a scaffold type structure with 2" planking that would be used
to provide overhead protection.
