Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to:
a) On or about March 1, 1989 and at times prior to, employees working
approximately 13 miles up Trussel Creek, east of Sandpoint, Idaho,
were shoveling snow approximately 65 feet from where other employees
were falling trees. The trees in the area were at least 86 feet high.
The snow shovelers were exposed to the hazard of being struck by
falling trees.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is to:
1) Establish a formal written safety program to cover falling procedures
and other logging operations.
2) Establish a formal training program to better inform employees of
safe logging procedures.
3) Establish procedures to maintain a minimum of two tree lengths
between the fallers and all other workers.
4) Maintain strict supervision and enforcement of all safety and health
rules.
