Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which were
free from recognized hazards that were causing or likely to cause death
or serious physical harm to employees in that employees including, but
not limited to: nurses, nurses aides, housekeepers, laundry workers and
maintenance people were exposed to the hazard of being infected with
hepatitis Type B virus (HBV) and/or human immunodeficiency (HIV) virus
and/or other bloodborne pathogens through possible direct contact with
blood or other body fluids:
ESTABLISHMENT:  THE EMPLOYER DID NOT ENSURE THAT ALL EMPLOYEES WHO HAVE
DIRECT CONTACT WITH BLOOD OR BODY FLUIDS WERE FORMALLY TRAINED IN
PRECAUTIONARY MEASURES, EPIDEMIOLOGY MODES OF TRANSMISSION AND PREVENTION
OF HBV/HIV AND OTHER BLOODBORNE PATHOGENS.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO
CORRECT THIS HAZARD WOULD BE:  THE IMPLEMENTATION OF AN EMPLOYEE SAFETY
AND HEALTH TRAINING PROGRAM WHICH WOULD INCLUDE INTENSIVE EMPLOYEE
TRAINING THAT EMPHASIZED THE RISKS SEVERITY AND APPROPRIATE PERSONAL
PROTECTIVE EQUIPMENT ASSOCIATED WITH BLOODBORNE DISEASES, PARTICULARLY
HBV AND HIV.  THE PROGRAM SHOULD INCLUDE THOSE MEASURES OUTLINED IN
"JOINT ADVISORY NOTICE": U.S. DEPARTMENT OF LABOR/v.s. DEPARTMENT OF
HEALTH AND HUMAN SERVICES: PROTECTION AGAINST OCCUPATIONAL EXPOSURE TO
HBV AND HIV, (FEDERAL REGISTER VOL 52, NUMBER 210, 10/30/87) AND THE
COMMUNICABLE DISEASE CENTER'S RECOMMENDATION FOR PREVENTION OF HIV
TRANSMISSION IN HEALTHCARE SETTINGS (MMWR, 1987;36).

HAZARD WOULD BE THE ESTABLISHMENT AND IMPLEMENTATION OF A WRITTEN  EFFECTIV E

BODY FLUIDS.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD WOULD
BE TO OFFER HBV VACCINATIONS TO EMPLOYEES, FREE OF CHARGE, AND IN
AMOUNTS AND AT TIMES PRESCRIBED BY GOOD MEDICAL PRACTICE.
