Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to blood-borne pathogens: ENTIRE AMBULANCE COMPANY: THE EMPLOYER FAILED TO ADEQUATELY PROTECT EMPLOYEES FROM BLOOD BORNE INFECTION INCLUDING, BUT NOT LIMITED TO THE FOLLOWING INSTANCES: A. EMPLOYER DID NOT OFFER HEPATITIS B VACCINE TO EMPLOYEES FREE OF CHARGE B. EMPLOYER DID NOT IMPLEMENT A FORMAL, UNIVERSAL PRECAUTION PROGRAM WHICH ENSURES THAT ALL EMPLOYEES EXPOSED TO BLOOD AND/OR BODY FLUIDS WERE TRAINED IN UNIVERSAL PRECAUTIONS C. EMPLOYER DID NOT ENSURE THAT EVERY EMPLOYEE EXPOSED TO BLOOD OR BODILY FLUIDS WAS CLINICALLY EVALUATED INCLUDING HIV TESTING AS SOON AS POSSIBLE AFTER THE EXPOSURE, FURTHER EVALUATIONS AT 6 WEEKS, 16 WEEKS, AND 6 MONTHS AFTER THE INCIDENT. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD WOULD BE: 1. IMPLEMENTATION OF AN EMPLOYEE TRAINING PROGRAM ON UNIVERSAL PRECAUTIONS 2. OFFER HEPATITIS B VACCINE TO EMPLOYEES FREE OF CHARGE 3. TO ESTABLISH A PROCEDURE WHEREBY EVERY EMPLOYEE EXPOSED TO BLOOD OR BODILY FLUIDS IS CLINICALLY EVALUATED AND HIV TESTED, AS SOON AS POSSIBLE AFTER THE EXPOSURE, FURTHER EVALUATION AT 6 WEEKS, 16 WEEKS, AND 6 MONTHS AFTER THE INCIDENT.
