Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Jobsite: Depot Street, Wareham, MA: Both sides and rear of the rotating super structure of a Koehring #6644 crawler backhoe was not provided with a swing radius barricade to prevent employees from being injured from a moving counter-weight. One method, among other methods of abatement, would be to erect a swing radius barricade around the rear of the backhoe.
